Background of the Study
Cultural expression is an essential element of human dignity, identity, and social cohesion. The 1999 Nigerian Constitution provides for the protection of cultural rights and freedom of expression under Section 39, guaranteeing every citizen the right to freely express their culture and heritage (Olawale & Ahmed, 2023). However, cultural diversity in Nigeria has often been subjected to social, political, and economic challenges (Adeyemi & Yakubu, 2024). In Jos South Local Government Area, Plateau State, the interplay of diverse ethnic groups, religious identities, and cultural practices has led to tensions around the recognition and protection of cultural rights (Bello & Yusuf, 2024). Despite constitutional guarantees, cultural repression and marginalization continue to affect some communities in Jos South LGA, particularly minority ethnic groups who struggle to preserve their cultural heritage in the face of dominant cultural narratives (Adamu & Bello, 2024). This study explores the relationship between constitutional law and the right to cultural expression within this context.
1.2 Statement of the Problem
While Nigeria’s constitution guarantees the right to cultural expression, cultural rights are often overshadowed by political, ethnic, and religious conflicts (Usman & Ibrahim, 2024). In Jos South LGA, cultural tensions between ethnic groups and religious communities exacerbate the difficulty in exercising cultural freedom (Adeyemi & Yusuf, 2023). The unequal distribution of power and the lack of effective legal protections for cultural minorities have left many groups in Jos South LGA unable to freely express their cultural practices (Bello & Yusuf, 2024). This study investigates the extent to which constitutional law protects cultural expression and identifies barriers to its full realization in Jos South.
1.3 Objectives of the Study
To assess how constitutional law protects cultural expression in Jos South LGA.
To identify challenges in the enforcement of cultural rights and legal protection of minority cultures.
To propose recommendations for strengthening constitutional protections for cultural expression.

What challenges hinder the exercise of cultural rights in Jos South LGA?
What legal reforms are needed to enhance cultural rights protection under the Nigerian constitution?
1.5 Research Hypotheses
H₀: Constitutional law does not significantly protect cultural expression in Jos South LGA.
H₁: The marginalization of minority cultures contributes to the suppression of cultural expression in Jos South.
H₂: Strengthening constitutional and legal frameworks will enhance the protection of cultural expression in Jos South LGA.
1.6 Significance of the Study
This study provides valuable insights for policymakers, cultural rights organizations, and ethnic minority groups in addressing the challenges to cultural expression in Nigeria. The findings will contribute to developing legal frameworks that strengthen cultural rights protection and foster social harmony.
1.7 Scope and Limitations of the Study
This study is confined to Jos South Local Government Area, Plateau State, focusing on constitutional law and the protection of cultural rights in the area. It does not address broader national concerns or other regions in Nigeria.
